Terms of Service

1Agreement & who we are
These Terms of Service ("Terms") are an agreement between you and Crate Creatives LLC, doing business as Cassavona ("Cassavona," "we," "us," or "our"), a Missouri limited liability company providing real estate media services in Washington, MO and eastern Missouri. By using this website, booking a shoot, purchasing a membership, or using our services, you agree to these Terms. If you do not agree, please do not use the website or services.
2Turnaround & delivery
- Standard delivery: Shoots are delivered the next business day.
- Priority Delivery (add-on): Your listing jumps the editing queue and is delivered first thing the following morning.
- Large or complex orders: Unusually large properties or orders combining multiple services may require additional time; when that's the case, the expected delivery is set at booking.
- Specialized services: Floor plans, virtual staging, decluttering, video, and other complex edits may require additional time, communicated at booking.
- Delivery of final media occurs upon receipt of full payment.
3Weather
Shoots impacted by adverse weather are rescheduled, not refunded. Interior photography proceeds as scheduled; exterior and aerial shots are deferred until conditions allow, subject to availability. When conditions are overcast, a blue-sky replacement is provided on the primary exterior photo at no charge.
4Photo review & the Cassavona Promise
The client is responsible for reviewing media promptly on delivery. Issues must be reported within 12 hours of delivery; corrections requested after that window may incur fees. If media falls short of our standard due to our error, we will reshoot the affected service at no charge — and if the reshoot still falls short, the affected service will not be billed (the Cassavona Promise). Reshoots required by client-side issues (property unpreparedness, clutter, staging changes, added scenes) are a new booking and may incur fees.
5Floor plans & property data
Floor plans are produced from an on-site scan and are highly accurate, but all measurements and square footage are estimates for marketing purposes only — they are not a substitute for professional measurement and must not be relied on for appraisal, construction, or legal purposes. Any boundary markers or lot lines depicted in imagery are illustrative only; consult a licensed surveyor for exact boundaries. Interactive tour links remain active for 6 months from delivery and can be renewed on request.
6Virtual staging & AI edits
Virtually staged, decluttered, or AI-enhanced images are for marketing purposes only and will be labeled as virtually staged. Staged furnishings are not included with the property.
7Copyright & license
- Ownership: Cassavona retains full copyright in all media produced. Clients receive a limited license, not ownership.
- License granted: The listing agent named on the invoice is granted a non-exclusive, non-transferable license to use the media solely for marketing the specific listed property, under that agent's name, for the duration of the active listing term. The license ends when the listing sells, expires, or is withdrawn.
- Relisting: If the property is relisted — by the same agent or a new one — continued use requires a new or extended license. A subsequent listing agent must purchase their own license.
- No transfer: Media may not be sold, licensed, shared, or distributed to any third party — including sellers, other agents, brokerages, builders, or vendors — without written permission.
- Other uses: Any use beyond marketing the listed property — including short-term rental platforms (Airbnb, VRBO), builder or vendor portfolios, or other commercial use — requires a separate shoot and/or separately negotiated license.
- Editing: Media may not be altered (color changes, adding/removing content, heavy cropping) except by Cassavona or with written approval. Minor resizing and cropping for platform requirements are permitted.
- Re-licensing: Cassavona reserves the right to license the media to third parties under separate agreements.
- Infringement: Unauthorized use, reproduction, modification, or distribution terminates the license immediately and may result in licensing fees, damages, legal fees, and legal action.
- Portfolio: Cassavona retains the right to display all work in its portfolio and marketing.
8Payments, deposits & payment processing
- Deposit: A 10% deposit is due at booking and is applied toward the total invoice.
- Balance due: The remaining balance is due on delivery of media. Final media is released upon receipt of full payment.
- Late payment: Balances unpaid 7 days after delivery accrue interest at 1.5% per month, and the media license is suspended until the balance is paid in full — continued use of the media while unpaid is unlicensed use. Reasonable costs of collection are recoverable.
- Payment processing: Cassavona does not process payments itself and does not collect or store payment card numbers or bank credentials. All payments are handled by third-party payment processors — including Stripe and the payment provider built into our booking platform. Your payment details are provided directly to the processor and are governed by that processor's own terms and privacy policy. We receive only limited transaction information (such as payment confirmation and amount) needed to manage your order or membership.
9Memberships & auto-renewal
Memberships are billed annually and renew automatically at the end of each annual term. A renewal reminder is sent before each renewal. You may cancel at any time; cancellation stops the next renewal and takes effect at the end of the current paid term. Member pricing, discounts, credits, and perks apply only while a membership is active and are non-transferable. Membership credits (including co-op advertising credits) are account credits toward Cassavona services — they have no cash value and expire when a membership ends. Your membership rate will not change during a paid term. Cassavona may adjust membership pricing, discounts, or benefits for future terms; any such change will be communicated at least 30 days before your renewal and takes effect at your next renewal — if you do not accept a change, cancel before the renewal date and it will not apply to you. Membership refunds — including the 7-day unused-membership guarantee — are governed by our Refund Policy.
10Cancellations & rescheduling
Cancellations or rescheduling made more than 48 hours before the scheduled shoot: the 10% deposit transfers in full to your rescheduled or next shoot. Cancellations within 48 hours of the scheduled shoot: the deposit is forfeited and does not transfer. Weather-related deferrals of exterior/aerial work (with interiors proceeding) are not cancellations — no deposit is affected.
11Property condition, occupancy & safety
The client must ensure the property is clean, photo-ready, and safe on arrival. We are not responsible for cleaning or staging, though we may make minor adjustments for lighting or composition; properties requiring significant preparation may incur additional fees. Basic Listing shoots require a vacant property unless the Occupied Home service is added. All pets must be secured and out of view during the session. If a property is unsafe, we reserve the right to end the session.
12Drone photography
Aerial work is performed by an FAA Part 107-licensed pilot and is subject to FAA regulations, local ordinances, and safe operating conditions. Flights may be deferred due to wind, rain, or airspace restrictions and will be rescheduled at the earliest safe opportunity.
13Travel
The first 25 miles from Washington, MO are free; miles 26–60 are billed at $2.00/mile; miles beyond 60 at $2.50/mile. Membership tiers may include reduced or waived travel fees as described at purchase.
14Liability & insurance
The client is responsible for ensuring the property is appropriately insured during the shoot. Cassavona is not liable for damages or injuries occurring during a session except where directly caused by our negligence. In all cases, Cassavona's total liability is limited to the amount paid for the affected service.
15Media storage
Final media is stored for 90 days from delivery. The client is responsible for maintaining their own copies for use during the listing period. Media should be deleted when the license ends.
16Website use & intellectual property
All content on this website — photography, text, graphics, logos, and design — is the property of Cassavona or its licensors and is protected by copyright and trademark law. You may browse the site for personal and business use related to our services; you may not copy, scrape, reproduce, or use site content for any other purpose without written permission. You agree not to misuse the website, interfere with its operation, or attempt to access systems or data not intended for you.
17Third-party services & links
Booking, galleries, payments, tours, and certain other features are provided through third-party platforms, and links on this site may lead to third-party websites. Those services are governed by their own terms and privacy policies, which we encourage you to review. Cassavona is not responsible for the content or practices of third-party services.
18Disclaimers & limitation of liability
The website is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Cassavona disclaims all warranties and will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or services. Nothing in these Terms limits liability that cannot be limited under applicable law.
19Governing law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts serving Franklin County, Missouri.
20Changes, severability & entire agreement
We may update these Terms from time to time; the "Last updated" date above reflects the current version, and continued use of the website or services after changes take effect constitutes acceptance. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with your invoice and our Privacy Policy, are the entire agreement between you and Cassavona regarding the services.
